Surendranagar vs Shree

High Court Of Gujarat|21 June, 2012

JUDGMENT / ORDER

ADMIT.
Though served, nobody appears on behalf of the respondent.
The following substantial questions of law arise for determination in the present Second Appeal;
(i) Whether the learned trial Court is justified in dismissing the suit on the ground that the same was barred by limitation?
(ii) Whether in the facts and circumstances of the case the period of limitation would commence from the date on which the contract was abandoned by his Contractor and/or from the date on which contract was terminated in favour of first Contractor or from the date on which final bill was prepared in favour of the second Contractor?
