Heard learned counsel for the petitioners, learned counsel appearing for respondents 6 to 10, learned Standing Counsel for the 5th respondent and the learned Government Pleader.
2. The petitioner, who claims to be the General Secretary of a trade union, has come up with this Writ Petition as a public interest litigation seeking a prayer for quashing Exhibit P4 by which the NABARD has sanctioned an amount by letter dated 19.3.2013 for recapitalisation of PWCS under package as sanctioned by the Government. The petitioner submits that the amount sanctioned has not been properly disbursed and distributed to eligible Societies. He submits that the scheme has not been properly implemented as per the WP(C).8555/13 2 guidelines. He submits that he has also filed a criminal complaint before the Chief Judicial Magistrate. He also claims to have submitted certain representations to the Director, Directorate of Handlooms & Textiles.
3. The amount has been sanctioned under the package of 'Revival, Reform and Restructuring Package for Handloom Sector” and the Ministry of Textiles NABARD was chosen for implementing the financial package for the Handloom sector.
4. The allegations, which have been made in the Writ Petition require adjudication of facts looking into various other factual situations, which cannot be done by this Court in a writ proceedings. If so advised, the petitioner may, with clear details of irregularity, if any, submit a fresh representation to the Director, Directorate of Handlooms & Textiles, Thiruvananthapuram, who may look into the complaint and take appropriate action as required.
