JUDGMENT / ORDER

By way of present application, present applicant-convict has prayed to grant parole for after death rituals i.e. Asthi Visharjan of his younger brother, which is to be performed at Haridwar.
Learned APP Ms. C.M.Shah has opposed the application and submitted that earlier when the applicant-convict was released on interim bail, he had not returned to jail and he was arrested after 777 days, therefore, this application deserves to be rejected.
I have perused the papers produced on record. The Administrative Officer, Office of Inspector General (Jail) has passed the order on 06.03.2012, rejecting the parole application of present convict on the grounds that the Police Commissioner, Zone-5, Ahmedabad has given a negative opinion and earlier when he was released on interim bail, he had not surrendered and remained absconded. Therefore, there being no cogent reason to exercise the discretion in favour of the applicant-convict, this application is rejected.
