JUDGMENT / ORDER

Heard learned advocate for the petitioner. It is submitted that pursuant to the settlement agreement dated 08.06.2009 signed by the complainant as well as petitioners herein, Memorandum of Understanding dated 08.06.2009 was drawn to withdraw all the cases against each other and when the petitioners herein withdrew their complaint under Negotiable Instruments Act, the impugned proceedings have been taken up, which is contrary to the terms and conditions of the settlement.
In view of the above, issue notice returnable on 5th March, 2012.
In the meanwhile, ad-interim relief in terms of para 7[C] of this petition.
