Heard Sri Majahar Ali, learned counsel for the applicants and Sri Amit Sinha, learned AGA for the State.
This application under Section 482 Cr. P.C has been filed by the applicants, seeking quashment of further proceedings of Case No.507 of 2019 (State Vs. Surendra and Others) arising out of case crime No.133 of 2018 under Sections 452, 506, 427, 323, 504 of IPC, Police Station Ghanghata, District Sant Kabir Nagar, pending in the Court of Additional Civil Judge (SD)/Additional Chief Judicial Magistrate, Sant Kabir Nagar as well as Charge-sheet dated 30.4.2018 along with cognizance order dated 11.02.2019.
After arguing the matter for some time, learned counsel for the applicants wants to withdraw this application with liberty to file regular application seeking bail before the trial Court. He submits that a direction may be issued to the trial Court to decide the bail application expeditiously, so that the applicants may not suffer any further injury.
State counsel, however, submits that discretion be given to the trial Court to decide the bail application in accordance with law.
This application is accordingly, dismissed, as withdrawn with the aforesaid liberty.
Needless to state that in the eventuality of filing any such application, the competent Court shall decide the same strictly in accordance with law.
