Heard learned counsel for the petitioners and Sri Manoj Kumar Yadav, learned counsel appearing on behalf of respondent no.3.
This writ petition has been filed for issuance of mandamus directing the Consolidation Officer, Sadar, Jaunpur to decide the restoration application filed by the petitioners dated 14.9.20 1 within stipulated time.
The contention of learned counsel for the petitioners is that he filed application under Rule 109A (2) of the U.P.C.H. Rules, 1954, which was allowed vide order dated 22.2.1990. Subsequently, the said order was recalled ex parte at the instance of the Gaon Sabha vide order dated 2.8.2010. Thereafter petitioners filed the recall application on 14.9.20 1 for recalling the order dated 2.8.2010 which is pending since 2011.
Under these circumstances, direction is issued to Consolidation Officer, Sadar, Jaunpur to decide the restoration application filed by the petitioners dated 14.9.20 1 expeditiously preferably within a period of six months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
