Case is taken up through video conferencing.
The writ petition is being filed seeking following reliefs:-
" (i) a writ or direction in the nature of certiorari to quash the impugned First supplementary Correction voter list dated 16.4.2021 in respect of petitioners whereby the names of the petitioner were cancelled from the final voter List, contained in annexure no.1 to this writ petition.
(ii) a writ order or direction in the nature of certiorari to quash the impugned order dated 16.4.2021 passed by opposite party no.4 & 5 whereby the Nomination papers of the petitioner no.1 for the candidate of Village Pradhan of Village Panchayat Barauki, Block-Ganj, Muradabad, District-Unnao after summoning the originals.
(iii) a writ order or direction in the nature of mandamus commanding the opposite parties to conduct the election of village pradhan of Gram Panchayat Barauki, Block-Ganj, Muradabad, District-Unnao by incorporating the nomination of the petitioner no.1 in the interest of justice............"
Learned Additional Chief Standing Counsel appearing for opposite party No.4 informs that election in question has already been completed and final results have been declared. At this stage, the relief claimed can not be granted. It is also submitted that the petitioner has a remedy of filing an election petition under the Panchayat Raj Act.
In this view of the matter, the writ petition is accordingly dismissed. The petitioner shall have the remedy to avail remedy, if any under the law.
