Petitioner is substantively holding the post of Gram Panchayat Adhikari. He was allowed to officiate as ADO Panchayat. Subsequently regular incumbent on the post of ADO Panchayat has joined and petitioner consequently is allowed to work as Gram Panchayat Adhikari. Grievance of the petitioner is that since he is the senior most Gram Panchayat Adhikari in the district and large number of vacancies on the post of ADO Panchayat are lying vacant, therefore, in view of the Government Order, dated 23.11.2015, his claim for officiation on the higher post is liable to be considered.
Learned Standing Counsel states that petitioner's grievance would be examined by the competent authority, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of permitting the petitioner to represent his grievance before respondent no. 2, who shall get the facts enquired into and ensure that principle of seniority is not compromised in the matter of grant of officiating charge to the post of ADO Panchayat and an appropriate order in that regard is passed within a period of two months, from the date of presentation of a copy of this order.
