Petitioner appears to have approached respondent no. 1 with the grievance that in accordance with the provisions of the Uttar Pradesh Public Services (Reservation for Physically Handicapped, Dependants of Freedom Fighters and Ex-Servicemen) (Amendment) Act, 2018, the State Government is required to identify four percent posts for physically handicapped persons. Such vacancies will have to be filled by promotion from eligible candidates in the feeding cadre.
Learned counsel for the petitioner submits that the petitioner is an Additional Statistical Officer and his claim is liable to be considered for promotion to the post of Block Development Officer, but only because vacancies have not been earmarked by the State, as such, the benefit of promotion is not being granted to the petitioner.
Learned Standing Counsel states that such grievance of the petitioner would be examined by the competent authority.
Perusal of the record would go to show that petitioner in respect of such grievance has already approached the respondent no. 1 by way of a comprehensive representation made on 22.5.2019. It would, therefore, be appropriate to dispose of this writ petition permitting the petitioner to annex copy of his previous representations together with a certified copy of this order and submit the same before the respondent no. 1 within two weeks from today. The concerned authority shall ensure that appropriate action in terms of the aforesaid statutory provision is undertaken, and a specific order would be passed within a further period of three months, thereafter.
With the aforesaid observations and directions, this writ petition stands disposed of.
