Heard learned counsel for the petitioner and Sri P.K.Chauhan, learned Standing Counsel for the State-respondent.
Petitioner is before this Court assailing the order impugned dated 31.08.2018 passed by the District Supply Officer, Kannauj, whereby licence of the fair price shop of the petitioner has been suspended as well as order dated 31.08.2018 attaching cardholders of petitioner's shop with another fair price shop as an alternative arrangement.
At the very outset, learned Standing Counsel raised an objection that against the same, the opportunity has already been extended to the petitioner for filing an objection.
In the facts and circumstances, no useful purpose would be served in keeping the writ petition pending and with the consent of the parties, the writ petition is disposed of finally with a direction in case, any such objection is filed by the petitioner within three weeks from today, the competent authority would proceed strictly, in accordance with law to decide the same as expeditiously as possible and preferably within further two months time but certainly after affording opportunity to all stakeholders in the matter. Any third party interest, meanwhile, would be subject to outcome of the objection so filed by the petitioner.
