The present writ petition has been filed commanding respondent No. 4 to institute proceedings under Section 67 of the Uttar Pradesh Revenue Code, 2006 on the basis of the report of the Revenue Inspector.
The averments made in the writ petition in support of the relief prayed relating to Plot No. 226.
It has been alleged by the petitioner that certain villagers have encroached over disputed plot, which is recorded as pond in the revenue records. The revenue record annexed with the writ petition indicates that only Plot No. 226Ka has been recorded as pond.
The revenue record do not tally with the averments made in the writ petition regarding the plot number.
The counsel for the petitioner prays that the writ petition be dismissed as withdrawn with liberty to file fresh writ petition indicating the proper plot number.
On the prayer of the counsel for the petitioner, the writ petition is dismissed as withdrawn with liberty as prayed.
