This petition has been preferred for the respondents being commanded to promote the petitioner on the post of Pradhan Sahayak. A further direction is sought for the supply of a copy of the enquiry report.
From the record it transpires that disciplinary proceedings have been initiated against the petitioner and upon conclusion of which the Enquiry Officer has submitted an enquiry report to the Disciplinary Authority.
Presently learned counsel is unable to state when the enquiry report was furnished to the Disciplinary Authority. Since the disciplinary proceedings are still pending, no cause arises for issuance of the writs as prayed for promotion of the petitioner. Insofar as relief no.2 is concerned, the Court finds no justification to presume that the Disciplinary Authority before proceeding further shall not provide a copy of the enquiry report as is mandatorily required in law.
Consequently this petition shall stand disposed of.
