Heard Sri Rajesh Kumar Tiwari, learned counsel for the petitioner and the learned Standing Counsel appearing for the State-respondents.
By means of this writ petition the petitioner claims that pursuant to a road widening project, his land has been acquired but compensation has not been paid to him.
In case, the petitioner has a clear title over the land and such land has been taken over for widening of road in public interest, then the petitioner would be entitled to compensation. The Executive Engineer, Public Works Department is stated to be the appropriate authority to look into the grievance of the petitioner.
The writ petition is disposed of with the direction to the Executive Engineer-respondent no.3 that in case the petitioner's land has been acquired for widening of the road and the petitioner has a clear title over the land, his claim for compensation, be considered and appropriate orders be passed in accordance with law, as far as possible, within a period of three months from the date a certified copy of this order is presented before the authority concerned.
