Heard learned counsel for the petitioners.
Petitioners are plaintiffs in Original Suit No.195 of 2004. Their application for amendment of the plaint has been rejected by the court below which order has been upheld in revision also.
Petitioners by the aforesaid amendment wanted to add that during the pendency of the suit certain constructions have been raised but the courts below have rejected the same with the reasoning that the constructions were old and were not be made during the pendency of the suit. The order is interlocutory in nature which can be challenged in appeal, if the decision in the suit goes against him.
In this vew of the matter, I am not inclined to interfere in the matter in exercise of writ jurisdiction.
Petition dismissed with the above observation.
