Heard learned counsel for the parties.
The present petition has been filed with the following prayer:
"A) Issue an appropriate writ, order or direction in the nature of mandamus commanding the opposite parties to grant the arrears of differences of salary and encashment on second promotional pay scale Rs.8000-13500/- to the petitioners w.e.f. the date when he had completed 24 years services, as it has been paid to the similarly situated Collection Amin of several District like Deoria, Bahraich, Raibareli, Amethi, Kannauj etc. vide government order dated 24.07.2018 and also pay 3rd ACP on completion of 26 years' service as per the 6th Pay Commission and re-fixed/pay all retiral dues."
Learned Standing Counsel submits that the fourth respondent, Collector/District Magistrate, District Gorkhpur, shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of with liberty to the petitioners to file fresh representation along with self attested computer generated copy of this order downloaded from the official website of High Court Allahabad and the writ petition, before the fourth respondent, Collector/District Magistrate, District Gorakhpur. In the event, such representation is filed, the same shall be considered and decided on merits by reasoned and speaking order, expeditiously, preferably within a period of eight weeks from the date of filing of copy of this order along with copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioners on merits.
