Ms. Manisha Chaturvedi, learned Advocate has put in appearance on behalf of the petitioner.
The present writ petition is directed against the order dated 2.2.2018 wherein the claim of the petitioner for grant of handicap allowances has been rejected on the basis that he did not produce the disability certificate as per the provisions of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1996.
Learned Standing Counsel has received instructions from the office of the Chief Medical Officer, Gorakhpur and has produced the disability certificate dated 23.4.2018 which has been prepared by the Chief Medical Officer, Gorakhpur in the standard format of the certificate.
It is thus submitted by the learned Standing Counsel that the grievances raised by the petitioner in the present writ petition have been met by the competent authority.
In the said circumstances, the present writ petition is being disposed of with the direction to the respondent no. 2 namely the District Magistrate, Gorakhpur to take a decision for payment of disability allowances to the petitioner on presentation of the disability certificate as early as possible.
