Heard learned counsel for the petitioners.
Present petition has been filed for setting aside the order dated 5.9.2017 passed by Civil Judge (S.D.) F.T.C., Fatehpur in Suit No. 114 of 1998 (Surendra Kumar and others vs. Sankar Lal and others).
Submission of learned counsel for the petitioners is that the amin report has been rejected illegally and there is no cogent reason to reject the same.
I have considered the submissions and have perused the record.
The impugned order clearly indicates that while submitting the report amin has not decided the two fixed points in opposite directions, which are to be verified with two fixed points, whereas in the present report only in one direction fixed point has been marked and the same cannot be accepted.
Under such circumstances, I do not find any legal infirmity in the order impugned herein.
Present petition is accordingly dismissed.
