The petitioner has come up with a prayer that he be allowed to appear in Semester-4 Examination of LLB Course-2011-12.
Sri Rohit Pandey, who appears for the respondent University, has informed the Court that there may be some difficulty in allowing the petitioner to appear in the back paper examination on account of the fact that the back paper examination has to be given within a specified period which, according to his instruction, is six years.
Be that as it may, since this aspect can be examined by the concerned authority of the University and an appropriate decision, after recording reasons can be taken, without expressing any opinion on the merits of the claim of either party, this Court considers it appropriate to dispose of this petition by giving liberty to the petitioner to represent his cause before the third respondent (Controller of Examination, Chhatrapati Shahu Ji Maharaj University, Kanpur). If any such representation is filed within two weeks from today, along with certified copy of this order and all relevant documents to show that the petitioner is entitled to give back-paper examination, as claimed, appropriate decision shall be taken by the third respondent in accordance with law after recording reasons, preferably, within a period of three weeks from the date of filing of such representation.
The petition stands disposed of as above.
