This writ petition has been filed for the removal of the encroachment from over Khata No. 49, Khasra No. 26, situate in village Mohammadpur Dhedha, P.S. Moradanagar, Tehsil - Modinagar, District - Ghaziabad.
Learned Standing Counsel submitted that if the petitioner is aggrieved by the encroachment over the Gaon Sabha land, he may take recourse to the filing of an application/case under Sections 67/136 of the U.P. Revenue Code, 2006.
Under such circumstances, without going into the merits of the case, it is being directed that if the petitioner files a case under Section 67/136 of the U.P. Revenue Code, 2006, within a period of 15 days from today, then the same shall, after hearing all the parties concerned, be decided within a period of 90 days thereafter, if there is no legal impediment.
With these observations, the writ petition is disposed of.
