Heard learned counsel for the revisionist.
The instant revision under Section 115 CPC is directed against an order passed at the appellate stage, rejecting an application for amendment of written statement, filed by the revisionist.
The revision is not maintainable in view of the Full Bench decision of this Court in Jupiter Chit Funds vs. Dwarka Diesh & Ors. :AIR 1979 ALL 218 which holds that an order passed at the appellate stage is not revisable under Section 115 CPC.
The revision is, therefore, dismissed as not maintainable.
