ORDER:
This writ petition is filed for the following substantive relief: “….to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in demanding Rs.74,000/- towards Development Charges against the petitioner company as illegal, arbitrary and unconstitutional and against the principles of natural justice besides in violation of Article 19 of the Constitution of India and pass such other order or orders as deemed fit and proper in the circumstances.”
At the hearing, Mr. Harsh Kumar Asthana, learned counsel for the petitioner, submitted that post filing of the writ petition, the respondents have withdrawn the impugned demand and that, therefore, the cause in the writ petition has become infructuous.
In view of the above submission, the writ petition is dismissed as infructuous.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.25552 of 2014 shall stand disposed of as infructuous.
