The only prayer made in the instant petition is for issuing direction to the Appellate Court to decide Misc. Appeal No. 25/2011, expeditiously, within a time specified by this Court.
The appeal is pending at the instance of the plaintiff respondent. It is pointed out by learned counsel for the petitioners that the respondent is deliberately delaying the disposal of the appeal. Several dates have been fixed for final hearing, but on account of delaying tactics adopted by the respondent, the matter is getting delayed.
Having regard to these facts, the instant petition is disposed of by directing the Appellate Court to decide the Misc. Appeal No. 25/2011, expeditiously, without granting unnecessary adjournments.
