This writ petition has been filed by the petitioners with the following prayer:-
"(I) Issue a writ order or direction in the nature of MANDAMUS commanding the respondent no.2 to decide the representation of the petitioner dated 02.07.2019 and the application as Case No. 31 of 2018 within stipulated period of time (Annexure-2 & 3 to the writ petition) (II) Issue any other writ order or direction as this Hon'ble court may deem fit and proper under the facts and circumstances of the present case (III) To award the cost of petition in favour of the petitioner."
We have perused the averments made in the writ petition and the documents appended thereto. It appears that the petitioners' land situate in village Arsadpur, Pargana, Tehsil Ghazipur, District Ghazipur, was acquired by the respondents under the provisions of the National Highways Act, 1956, in the year 2015-16.
Aggrieved by the compensation awarded, the petitioners moved an application for determination of compensation which was registered as Case No.31 of 2018.
The grievance of the petitioners is that despite lapse of considerable time, Case No.31 of 2018 has not been decided till date by respondent no.2.
In view of above, without expressing any opinion on the merits of the case, we dispose of the writ petition with the direction to respondent no.2 to decide the Case No.31 of 2018 as expeditiously as possible, within the statutory period provided under Arbitration and Conciliation Act, 1996.
