Heard learned counsel for the applicant; Shri Mithilesh Kumar Ojha, learned counsel for the informant and learned A.G.A for the State.
The instant anticipatory bail application has been filed on behalf of the applicant, Suresh, with a prayer to release him on bail in Case Crime No.173 of 2018 (S.T. Bo. 492 of 2020), under Sections- 366,376-D IPC, and section 6 POCSO Act Police Station- Arania District- Bulandshahr, during pendency of trial.
Applicant has approached this court after filing application under section 482 No. 14872 of 2020, which is pending, wherein applicant has challenged the summoning order passed by the court below rejecting the final report against him and summoning him by order dated 29.2.2020.The applicant has not brought on record ordersheet indicating what has happened after summoning order passed by the court below.
In view of the fact the applicant has approached this court for quashing the summoning order earlier, it is not a fit case for grant of anticipatory bail.
The application is, accordingly, dismissed.
