Heard Shri Sunil Kumar Singh, learned counsel for the petitioner and Shri J.K. Singh holding brief of Shri Rakesh Pande, learned counsel for the respondents.
The petitioner is seeking quashing of the order dated 30.08.2017 whereby he has been informed that he will retire from service on attaining the age of superannuation of 58 years. According to the petitioner he will retire from service in June, 2018 as a work charge employee. The petitioner is stated to have preferred a representation before the Project Manager, Uttar Pradesh Project Corporation Ltd., Azamgarh on 18.09.217 (Annexure-9 to the writ petition) to consider his claim for regularization after which his date of retirement would be 60 years.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.3, Project Manager, Uttar Pradesh Project Corporation Ltd., Azamgarh to consider and decide the petitioner's representation dated 18.09.2017, Annexure-9 to the writ petition in accordance with law within a period of three months from the date a certified copy of this order is received in his office.
The petitioner shall also provide a copy of the representation dated 18.09.2017 alongwith the certified copy of this order to the respondent no.3.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
