Heard learned counsel for the petitioner and learned A.G.A. for the State.
The petitioners herein seek issuance of a writ in the nature of certiorari quashing First Information Report bearing Case Crime No. 0142 of 2021, under Sections 147,302,323,506, IPC Police Station- Thangaon, District-Sitapur.
Contention of the learned counsel for the petitioners is that the petitioners have been falsely implicated in the aforesaid case crime number. In fact the deceased accidentally hit a hand-pump. All the injuries are on the forehead. There are no lathi-danda blows on his body.
These pleas cannot be a ground for quashing the F.I.R. It is open for the petitioners to apply for bail as per law. In this view of the matter this petition is dismissed, however, without prejudice to the rights of the petitioner in the pending investigation and to avail the remedy under section 439 Cr.P.C Order Date :- 19.5.2021 A.Nigam
