Heard learned counsel for the applicant as well as learned A.G.A for the State and perused the record.
By means of this application, the applicant who is involved in S.T. No. 217 of 2017 (State vs. Suresh Pathak), arising out of case crime no. 216 of 2017, under Sections 420, 504, 506 IPC and Sections 3 (1) (Dha) SC/ST Act, Police Station- Mauranipur, District- Jhansi, is seeking to decide the trial expeditiously within stipulated period.
Since the matter is pending since 04.11.2017 and two years have been passed but no appropriate order has been passed by the court below. It is appropriate to direct the court below to decide the matter expeditiously.
The learned trial Court is directed to gear up the matter and would make all necessary efforts to conclude the same expeditiously, from the date of production of certified copy of this order without granting unnecessary adjournment to either side and if there is no other legal impediment.
Learned counsel for the applicant undertakes that the defence would render all necessary cooperation in the early conclusion of trial.
