1. Petitioner is challenging promotion of respondent-4 on the post of Chief Engineer, Level-II. Cause of action and relief prayed in the writ petition is within the ambit of U.P. Public Services (Tribunal) Act, 1976 (hereinafter referred to as “Act, 1976”) and petitioner has a statutory alternative remedy by filing Claim Petition under Section 4 of Act, 1976 before U.P. State Public Services Tribunal. This fact could not be disputed by learned counsel for petitioner. He also could not advance any substantive argument so as to persuade us not to relegate the petitioner to avail the aforesaid statutory alternative remedy.
2. The writ petition is, therefore, dismissed on the ground of alternative remedy.
