Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"a) issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide the Case No.804 of 2014 along with Stay Application (Suresh Narain Vs. Deo Narain and others) within the stipulated period which is pending before the respondent no.2."
It has been stated that a partition suit filed in the year 2013 has not been disposed of finally till date.
Perusal of the order sheet reveals that till date written statement has not been filed by the defendants, who have put in appearance. The suit has been directed to proceed exparte as against whose, who have not put in appearance, therein.
Under the circumstances, this writ petition is disposed of directing the respondent no.2, Sub Divisional Officer, Tehsil Phoolpur, District Prayagraj to endeavour to decide the case of the petitioner, expeditiously, preferably within a period of twelve months from the date a certified copy of this order is filed before him.
