JUDGMENT / ORDER

1. Heard learned advocate Mr. H. S. Munshaw for the applicant, learned advocate Mr. J. A. Adeshra for the respondent No. 1 and learned Additional Public Prosecutor Mr. K. L. Pandya for the respondent No.

2. Present application, under Section 5 of the Limitation Act, has been filed for condonation of delay of 46 days, caused in filing the criminal appeal, challenging the judgment and order of acquittal dated 31/07/2012, passed in Criminal Case No. 3119 of 2001 by learned 12th Additional Chief Judicial Magistrate, Bhavnagar.
3. The delay of 46 days, caused in filing the appeal, has been sufficiently and satisfactorily explained in the application, more particularly in Para 2 of the same. Hence, this application is allowed and the delay caused in filing the appeal is condoned. Rule is made absolute accordingly.
