Petitioner had applied for appointment to the post of Constable (GD) pursuant to recruitment exercise initiated by the Staff Selection Commission, Allahabad in the year 2011. Petitioner has scored marks below the cut off in the respectively category. His grievance is that though he has qualified in the re-medical test, but he is not being considered.
Shri Gyan Prakash, learned counsel for the respondents has placed reliance upon a decision of this Court in Writ A No. 48354 of 2017 decided on 20.08.2018.
This Court has taken note of the cut off list published on 28.11.2011, which has attained finality. Cut off in OBC category, as per the final list, is 58 marks; whereas, petitioner has scored only 45 marks, which is much below the cut off.
In such circumstances, petitioner can have no grievance as he failed to score marks above the cut off in the respective category. Even otherwise, there is no justification to entertain the petition seven years after declaration of final result.
The writ petition is, accordingly, dismissed.
