Heard learned counsel for the petitioner, learned Standing Counsel for the State.
Sri Bhupendra Kumar Tripathi, learned counsel has accepted notice on behalf of respondent no. 2.
Present petition has been filed seeking a direction to respondent no. 1 to restore the possession of the petitioner in Joint Arazi No. 326 area .012 hectare as per Chauhaddi given in lease (patta) dated 5.7.2011 situated in the village Ganeshpur, Pargana Barsathi Tehsil Mariyahun, District Jaunpur.
Learned Standing Counsel submits that the grievance of the petitioner can be redressed under Section 129 of U.P. Revenue Code, 2006.
Learned counsel for the petitioner submits that the petitioner has already filed an application under Section 129 of the U.P. Revenue Code, 2006, which is pending consideration before the authority concerned.
In view of above, the writ petition is disposed of with a direction to the authority concerned to consider and decide the aforesaid application, if any, filed by the petitioner expeditiously, preferably within a period of three months from the date of production of self attested copy of the order, which may be verified from the official website of this Court.
It is made clear that this Court has not considered the claim of the petitioner on merits.
The writ petition stands disposed of with the aforesaid observation.
