Heard learned counsel for the petitioner.
This writ petition has been filed praying for a direction to the opposite party No.2 to decide the Appeal No. C-201810000003532, Suresh Kumar Vs. Sub Divisional Magistrate, Tehsil Sadar, District Unnao, at the earliest.
It has been submitted by the learned counsel for the petitioner that the license of the fair price shop of the petitioner was cancelled on 09.11.2017. He filed the aforesaid appeal on 15.10.2018 along with the stay application. The appeal has been admitted on 01.11.2018 and record has been summoned, since then the appeal has remained pending. He has referred to the paragraph 13 of the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016, wherein, an appeal has to be decided within two months from the date of its filing.
Without entering into the merits of the controversy, this petition is disposed of with the direction to the opposite party No.2 to decide the pending appeal at the earliest, say, within a period of two months from the date of production of certified copy of this order.
