JUDGMENT / ORDER

Court No. - 35
Case :- WRIT TAX No. - 112 of 2019 Petitioner :- Shri Suresh Kumar Respondent :- Income Tax Officer Counsel for Petitioner :- Rishi Raj Kapoor Counsel for Respondent :- S.S.C.
Hon'ble Bharati Sapru,J. Hon'ble Piyush Agrawal,J.
Heard Sri R.R. Kapoor, learned Counsel for the petitioner and Sri Gaurav Mahajan, learned Counsel for the respondents-department.
The petitioner has filed this writ petition seeking a writ of certiorari to quash the impugned notice dated 28.03.2018 by which the authorities seek to reassess the petitioner for the year 2011-12 and an assessment order has been passed.
The assessment order is an appellable one. It is open to the petitioner to take recourse to the remedy of appeal and take all these objections over there.
We are not inclined to interfere in this matter at this stage in view of Hon'ble Apex Court in the case of Authorized Officer State Bank of Travancore and another vs. Mathew K.C. reported in (2018) 3 Supreme Court Cases 85.
The Writ Petition is disposed of. No costs.
Order Date :- 29.1.2019 S.P.
