Following orders were passed in the matter on 15.7.2019:-
"It is stated that though petitioner was substantively appointed in the year 1984 and has superannuated in 2010, but even provisional pension has not been released to him. It is contended that though a first information report was lodged in the year 1989 but no charge sheet has been filed till date. Submission is that denial of retiral benefits in such circumstances would be arbitrary.
Learned Standing Counsel may obtain instructions in the matter, by the next date fixed.
Put up as fresh on 29.7.2019."
Despite grant of opportunity, learned Standing Counsel has not been able to obtain instructions in the matter.
Learned Standing Counsel submits that grievance of petitioner for release of retiral benefits shall be examined by the authority concerned, in accordance with law.
Considering the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration to the petitioner's claim for release of retiral benefits alongwith interest in terms of the applicable Rule/ Government Order, by passing a reasoned order within a period of three months from the date of presentation of certified copy of this order. All consequential actions shall be taken accordingly.
