By means of this writ petition the petitioner has raised a grievance that on his Gata No. 881-Kha and 881-Anga, which is on the bank of Ken river, some sand has been accumulated and respondents are illegally transporting the sand from the land of the petitioner without any permit.
Upon query being made as to whether the petitioner has applied for transportation of sand from the appropriate authority, the answer is in the negative. So far as transportation by other persons is concerned from the land of the petitioner, a report has been submitted by the Mining Officer, Banda that no such illegal mining or transpiration of sand is being done.
In case the sand is on the land of the petitioner, he has to apply for appropriate permit for transpiration of the same.
In case the petitioner makes an application, the same will be dealt with in accordance with law.
With the aforesaid observation/direction, the writ petition is disposed of.
