The petitioner had filed a Writ Petition No. 210 of 2020 for consideration of his representation in respect of providing security to the petitioner. The said petition was disposed of by requiring the District Magistrate to take a decision on the representation. Pursuant thereto, according to the petitioner, a favourable decision was taken by the District Magistrate, Etah on 26.2.2020 but the said decision has not yet been implemented and therefore, the petitioner seeks a direction upon the District Magistrate to direct the Circle Officer/Station House Master, P.S. Aliganj to provide security to the petitioner.
The learned Standing Counsel has informed the Court that for the purposes of grant of security a District Level Committee, comprising District Magistrate, Superintendent of Police of the district and members of the Local Intelligence Unit, is there and it appears that there is no order passed by the District Level Committee in respect of providing security to the petitioner and, therefore, it would be appropriate to dispose off this petition by requiring the second respondent to place the matter relating to the security of the petitioner before the District Level Committee.
Considering that the District Level Committee has been constituted under the Government Order to examine claims in respect of according security to private individuals, we deem it appropriate to dispose off this petition by requiring the second respondent (District Magistrate) to place the matter of the petitioner in respect of demand for security to him before the District Level Committee within two weeks from the date of filing a copy of this order in his office. Thereafter, the District Level Committee shall take a decision on the claim of the petitioner, preferably, within next three weeks.
