By order dated 20.2.2018 in Writ-A No.6180 of 2018 filed by the applicant, this Court directed the State respondents to consider the claim of the applicant for appointment as Collection Amin under 35% quota reserved for Seasonal Collection Amins in case the vacancies are available.
Sri P.K. Giri, learned Additional Chief Standing Counsel, on instructions, states that there is a restraint order dated 28.5.2018 against the State respondents not to fill any post under 35% quota reserved for Seasonal Collection Amins in Writ-A No.54923 of 2018 Devki Nandan and others Vs. State of U.P. and others. He further points out that accordingly by an order dated 6.8.2018, the representation of the applicant has been rejected by District Magistrate, Hathras.
Counsel for the applicant submitted that the respondents should have deferred the matter instead of rejecting the representation.
Be that as it may, since, as on date, the claim of the applicant could not be considered on account of the restraint order, therefore, this Court is not inclined to proceed in contempt, but in case after the case is decided by the Writ Court and any right accrues or flows in favour of the applicant for being considered for appointment as Collection Amin, it goes without saying that the same shall be examined and appropriate decision would be taken at that stage.
The contempt application stands disposed of with the said clarification.
