Heard learned counsel for the parties.
Petitioner is before this Court with the request to command the District Inspector of Schools, Aligarh to forthwith take into consideration the request of petitioner and pass reasoned and speaking order for promoting him on the post of Head Clerk pursuant to issuance of notice dated 10.10.2017 on which the petitioner has already submitted a reply on 01.11.2017 within stipulated period.
Learned counsel for the petitioner states that in the present matter, the District Inspector of Schools, Aligarh vide letter dated 10.10.2017 had informed to the Manager/Principal of the Institution in question to submit report regarding vacancy of Head Clerk in the Institution in question. The copy of the same has also been served to the petitioner. He has informed to the Court that in response to the said letter, the petitioner has already submitted detailed response to the District Inspector of Schools, Aligarh on 01.11.2017 but the proceedings have not been finalized till date.
Learned Standing Counsel has not disputed the factual and legal aspect of the matter.
In the aforesaid facts and circumstances, no useful purpose would be served in keeping the writ petition pending.
With the consent of the parties, the Writ Petition stands disposed of asking the District Inspector of Schools, Aligarh to finalize the proceedings in question but certainly after taking necessary comments from the Principal/Management of the Institution in question expeditiously, preferably within a period of two months from the date of production of certified copy of this order.
