Heard learned counsel for the applicant and learned A.G.A. This application has been filed with a prayer to quash the N.B.W. issued against the applicant in complaint case crime no. 140 of 2007 under sections 467, 468, 471, 420 I.P.C. arising out of charge sheet submitted in case crime no. 142 of 2006, P.S. Malpura, district Agra. From the perusal of the record, it appears that due non appearance of the applicant N.B.W. has been issued, therefore, the prayer for quashing the same is refused.
However, in case the applicant appears before the court concerned within 15 days from today, N.B.W. issued against the applicant shall be kept in abeyance.
In case the applicant applies for bail, the same shall be heard and disposed of expeditiously, if possible, on the same day by the courts below. With the above direction, this application is finally disposed of. Order Date :- 27.1.2010 prabhat
