JUDGMENT / ORDER

Heard Sri Ajay Kishor Pandey, learned counsel for the petitioner and Sri Rishabh Kapoor, learned counsel for the opposite parties.
Learned counsel for the petitioner has contended that the petitioner retired from service on 31.7.2020 from the post of Routine Grade Clerk. As per learned counsel for the petitioner the petitioner has completed all necessary formalities for getting his post retiral dues but such dues have not been paid to the petitioner. Learned counsel for the petitioner has also drawn attention of this Court towards 'No Dues Certificate' dated 25.6.2020 which is contained as Annexure no. 3 to the writ petition by submitting that there is nothing due against the petitioner. He has also submitted that the petitioner has been suffering with liver disease and treatment thereof is going on at Medanta, as medical papers to that effect has been enclosed as Annexure no. 4. He has submitted that to get treatment from private hospital is a costly affair and in absence of payment of post retiral dues the petitioner is suffering a lot as he is not able to get proper treatment and in that circumstances he has got threat to his life, therefore, learned counsel for the petitioner has submitted that the opposite parties may be directed to make payment of entire post retiral benefits e.g. gratuity, leave encashment, group insurance etc. Sri Rishabh Kapoor, learned counsel for the opposite parties has however, submitted that the financial condition of the opposite party institution is not so sound, therefore, the payment of post retiral benefits are not made to the employees promptly, however, the opposite parties take all positive endeavour to make the payment of post retiral benefits to its employees. Sri Kapoor has further submitted that since medical condition of the present petitioner is not good as shown in the writ petition and his treatment is going on at private hospital, therefore, the opposite parties shall take extra effort and sincere endeavour to make payment of post retiral dues to the petitioner with promptness and for that four months time may be given.
Considering the rival submissions of learned counsel for the parties and also considering the medical condition of the present petitioner, I hereby direct the opposite parties to make payment of post retiral dues to the petitioner within a period of 10 weeks. It is also provided that at least some of the amount be paid to him within three weeks so that he could get proper treatment from the hospital and remaining amount be paid within time prescribed, if there is no legal impediment.
Accordingly, the writ petition is disposed of.
