JUDGMENT / ORDER

Hon'ble Mahendra Dayal,J.
Preliminary objection raised by the learned Standing Counsel that the petitioner has already filed a Writ Petition No. 4172(M/B) of 2000 with the same cause of action which has been withdrawn as not pressed without any liberty and as such the present writ petition is not maintainable under the provisions of Chapter XXII Rule 8 of Allahabad High Court Rules.
A prayer has been made on behalf of the learned counsel for the petitioner that he is not in a position to conduct the case today.
The case is adjourned.
