JUDGMENT / ORDER

Application filed under Section 438 of the Code of Criminal Procedure.
2. Petitioner is the accused in Crime No.1486 of 2014 of the Chingavanam Police Station registered for the offences punishable under Sections 341, 294(b), 324, 506(i) and 354 of the Indian Penal Code.
3. The allegation against the petitioner is that on 28.08.2014 at about 04.30 p.m., he obstructed the car that was being driven by the de facto complainant, woman with his scooter on the road and abused the de facto complainant. When she got out of the car, he indiscriminately beat her on her head and back of her neck with his helmet. The churidar worn by her was torn away.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. The contents of the CD prima facie reveal the complicity of the petitioner. The investigating officer has

2 reported that again on a subsequent date, the petitioner and his associates had attacked the de facto complainant and severely abused her and threatened her, for which Crime No.1516 of 2014 of the Chingavanam Police Station has also been registered. It is true that the offences allegedly in the said crime are bailable. At the same time, considering the seriousness of the allegations against the petitioner in this case and especially when such acts have been repeated by the petitioner, I am of the view that this is not a fit case wherein anticipatory bail can be granted.
In the result, this bail application is dismissed.
