1. The present Civil Application under Section 5 of the Limitation Act has been preferred by the applicant herein to condone the delay of 167 days in preferring the Second Appeal against the judgment and decree passed by the learned 6th Additional District Judge, Surat in Regular Civil Appeal No. 41/1998.
2. As the application is not seriously opposed by the learned advocates appearing on behalf of the respective respondents, more particularly, Shri Thakkar, learned advocate appearing on behalf of the private respondents, the present is allowed and the delay caused in preferring the Appeal is hereby condoned. Rule is made absolute accordingly. No cost.
