(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) Counsel for the applicant pointed out that the competent authority under the Payment of Wages Act by an order dated 14.11.11 directed the respondents herein not to transfer or shift or create any charge on the immovable properties as well as machinery till final disposal of the main proceedings. She pointed out that despite such clear direction, the respondents have sold all the machineries as can be seen from the comparison of two reports of the Commission dated 15.10.11 and 21.12.2012. Counsel pointed out that a Division Bench of the Bombay High Court in the case of Registrar, High Court v. S.K.Irani, 1963 Bombay 254, has held that Authority under the Payment of Wages Act is a court for the purpose of Contempt of Courts Act.
Issue notice returnable on 20th June 2012.
