Ms. C.M. Shah, learned APP waives service of notice of rule on behalf of the respondent-State.
The present application, through jail, has been preferred by the applicant-Surajsinh @ Sonu Collectorsinh to release him on temporary bail for a period of 60 days to undertake the agricultural activity.
Apart from the fact that his earlier application, being Criminal Miscellaneous Application No. 10738/2012, to release him on temporary bail came to be dismissed by the Division Bench of this Court vide order dated 23/07/2012 and considering the fact that the father of the convict as well as other co-owners can undertake the agricultural activities, no case is made out to release the applicant on temporary bail on the ground stated in the application. Hence, the present application deserves to be dismissed and is accordingly dismissed. Rule is discharged.
