1. Rule.
Mr. M.G.Nanavati, learned APP waives service of notice of rule on behalf of Respondent-State.
2. The instant application is filed seeking temporary bail for twenty days in connection with Limbayat Police Station, District : Surat bearing CR No. I - 91/2011 on the ground of sickness of his wife.
3. Having considered the submissions advanced by on behalf of both the sides, so also considered the medical certificate on record, it transpires that the operation of the wife of the applicant is scheduled on 30/06/2012.
4. In above view of the matter, the application is partly allowed and the applicant is ordered to be released on temporary bail for a period of two weeks from the date of actual release on executing personal bond of Rs. 10,000/- with surety of like amount to the satisfaction of the concerned jail authority on the condition that during the period of his temporary bail, he shall maintain law and order and shall not take disadvantage of his liberty and on completion of the period of his temporary bail, he shall immediately surrender to concerned jail authority.
5. Rule is partly made absolute to the aforesaid extent. Direct service is permitted.
