JUDGMENT / ORDER

Heard learned counsel for the applicant and learned A.G.A. for the State.
The applicant is in jail since 8.5.2010 under Section 420 I.P.C., 33- I and 33-J Drugs and Cosmetic Act, 1940. There is no allegation that the applicant is involved in manufacturing fake Kalyan Dant Manjan. There is neither inducement nor any wrongful gain and, therefore, no offence under Section 420 I.P.C. is made out so far as the offence under Sections 33-I and 33-J of Drugs and Cosmetic Act, 1940 is concerned the maximum punishment is one year.
In view of these submissions, without expressing any opinion on merits, bail application is allowed.
Let the applicant Surajmal Bhardawaj son of Bhagwan Das involved in Case Crime No. 603 of 2010 under Section 420 I.P.C., 33-I and 33-J Drugs and Cosmetic Act, 1940, Police Station Subhas Nagar, District Bareilly be released on bail on executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
