Heard learned counsel for the accuse-applicant and learned AGA for the State.
It is contended by the learned counsel for the applicant that the marriage of real sister of the applicant is to be solemnized on 29th April 2018. Marriage card has been annexed as Annexure S.A. 1 to the supplementary affidavit filed in the Court today. Learned counsel for the applicant further contended that the hearing of this bail application is adjourned for two weeks and the applicant shall granted short term bail in order to enable him to participate in the marriage of his real sister, Km. Aruna.
Learned AGA does not dispute this fact. He, however, states that the applicant may be permitted to participate in the said marriage ceremony under Police custody.
Looking to the aforesaid submissions, we consider it appropriate to release the applicant on a short term bail.
Let the applicant, namely, Suraj @ Sudeep Dev Pandey involved in Sessions Trial No. 114 of 2015, arising out of Case Crime No. 739 of 2015, under Section-302 I.P.C., P.S-Robertsganj, District-Sonbhadra be released on short term bail starting from 28th April, 2018, on which date the applicant shall be released from jail under Police custody, on his executing a personal bond of Rs. 2 lacs with two solvent sureties of Rs. 2 lacs each in the like amount to the satisfaction of the C.J.M. concerned.
Both sureties shall be family members and/or same villagers of the applicant. His short term bail will lapse on 6th May 2018, on which date, the applicant is directed to surrender before the C.J.M. concerned.
The C.J.M. concerned shall submit his report to this Court on the return of the applicant to Jail immediately.
This matter shall come up on 11th May 2018 for final hearing, on which date an affidavit shall also be filed regarding surrender of the applicant.
