Heard learned counsel for the petitioner and Shri Yogendra Singh Bohra representing respondent no.3 i.e. District Basic Shiksha Adhikari-District Aligarh and respondent no.4 i.e. Block Education Officer, Dhanipur Block, District Aligarh.
The facts of the case are that the petitioner is senior-most teacher in the composite school, Alinagar, District Aligarh constituted by merger of the primary school and the junior high school. The petitioner is Assistant Teacher in the said institution. After retirement of the Headmaster of the institution, the Block Education Officer, Dhanipur, District Aligarh vide its order dated 31.8.2020 has directed the petitioner to take charge as Headmaster of the institution and has warned that on failure to comply, action shall be taken against her.
In the writ petition, the petitioner has stated that due to certain family problems and because of her ill-health, the petitioner would not be able to satisfactorily discharge her duties as Headmaster of the institution and, therefore, wishes to waive her right to be appointed as Incharge Headmaster of the institution. In this regard, the petitioner has also submitted a representation dated 7.9.2020 before the Block Education Officer, Dhanipur, District Aligarh.
The petitioner may submit a representation before the District Basic Shiksha Adhikari, Aligarh i.e. respondent no.3 bringing to his notice all the necessary facts and documents who on receiving the said representation shall decide the same within a period of three months from the date of filling the representation.
